3. conclusion of contract
By placing the products in the online store, we make a binding offer to conclude a contract for these articles. The contract is concluded when you accept the offer for the goods contained in the shopping cart by clicking on the order button. Immediately after sending the order, you will receive another confirmation by e-mail.
Condition for an effective conclusion of the contract is always that the ordering process is completed by sending the order.
4. shipping costs
In addition to the stated product prices, shipping costs will be added. You can find out more about the amount of the shipping costs in the offers.
5. payment
Payment can be made in advance, PayPal, Sofortüberweisung or credit card.
Prepayment
If you choose payment in advance, we will give you our bank details in the order confirmation and deliver the goods after receipt of payment. If your payment is not received in full on our account within 14 days, we are entitled to withdraw from the purchase contract without notice by canceling your order.
PayPal
In the order process you will be redirected to the website of the online provider PayPal. In order to pay the invoice amount via PayPal, you must be registered there or register first, legitimize with your access data and confirm the payment instruction to us. After submitting the order in the store, we request PayPal to initiate the payment transaction. The payment transaction is carried out automatically by PayPal immediately afterwards. You will receive further instructions during the order process.
Credit card
When you place your order, you also provide us with your credit card details. After your legitimation as a legitimate cardholder, we will request your credit card company to initiate the payment transaction immediately after the order. The payment transaction will be carried out automatically by the credit card company and your card will be charged.
Immediately
After placing the order, you will be redirected to the website of the online provider Sofort GmbH. In order to be able to pay the invoice amount via Sofort, you must have an online banking account with PIN/TAN procedure activated for participation in Sofort, identify yourself accordingly and confirm the payment instruction to us. You will receive further instructions during the order process. The payment transaction will be carried out immediately afterwards by Sofort and your account will be debited.
In principle, every Internet user can use Sofortüberweisung as a payment method if he has an activated online banking account with PIN/TAN procedure. Please note that Sofortüberweisung is not yet available at a few banks. 6. reservation of proprietary rights
The goods remain our property until full payment.
7. transport damages
If goods are delivered with obvious transport damage, please claim such defects as soon as possible to the deliverer and contact us immediately. Failure to make a complaint or contact us has no consequences for your legal claims and their enforcement, especially your warranty rights. However, they help us to be able to assert our own claims against the carrier or transport insurance.
8. cancellation policy
Right of withdrawal
You have the right to revoke the contract concluded with us within fourteen days without giving any reason. The revocation period is fourteen days from the day on which you or a third party named by you, who is not the carrier, has taken possession of the goods (or the last goods, part shipment or piece in the case of a contract for several goods of a uniform order or the delivery of goods in several part shipments or pieces).
To exercise your right of withdrawal, you must inform us by means of a clear statement of your decision to withdraw from the contract. You can use the model withdrawal form shown below for this purpose, but it is not mandatory.

To comply with the revocation period, it is sufficient that you send the notification of the exercise of the right of revocation before the expiry of the revocation period.
Consequences of revocation:
If you revoke the contract, we will reimburse you for all payments for the purchased goods that we have received from you and we will reimburse you for the costs of the cheapest standard delivery offered by us. This repayment will be made without undue delay and at the latest within fourteen days from the day on which we received the notification of your withdrawal from the contract. For this repayment, we will use the same means of payment that you used in the original transaction, unless expressly agreed otherwise with you. We will not charge you any fees for the repayment in any case. We may refuse repayment until we have received the goods back or until you have provided proof that you have returned the goods, whichever is the earlier.
You must return the goods received from us without undue delay and in any case no later than within fourteen days from the day on which you notify us of the cancellation of this contract. If you return the goods from Germany, we will bear the costs for this. The goods are to be returned by you in the case as follows:

The deadline is met if you send the goods before the deadline of fourteen days. You shall bear the direct costs of returning the goods. You will only have to pay for any loss in value of the goods if this loss in value is due to handling of the goods that is not necessary for checking the condition, properties and functioning of the goods.

09. liability
For claims based on damages caused by us, our legal representatives or vicarious agents, we are always liable without limitation
in case of injury to life, body or health,
in case of intentional or grossly negligent breach of duty,
in the case of warranty promises, insofar as agreed, or
insofar as the scope of application of the Product Liability Act is opened.
In the event of a breach of essential contractual obligations, the fulfillment of which is a prerequisite for the proper execution of the contract and on the observance of which the contractual partner may regularly rely (cardinal obligations) due to slight negligence on our part, on the part of our legal representatives or vicarious agents, liability shall be limited to the amount of the damage foreseeable at the time of the conclusion of the contract, the occurrence of which must typically be expected. Otherwise, claims for damages are excluded.

The European Commission provides a platform for online dispute resolution (OS), which you can find here https://ec.europa.eu/consumers/odr/. We are not obliged or willing to participate in a dispute resolution procedure before a consumer arbitration board.

The language available for the conclusion of the contract is German.
13. gift vouchers
Gift vouchers are vouchers that you can purchase. The voucher can only be redeemed online. The site must be listed on holymesh.com under "Our Shops" or be a section of holymesh.com for the gift certificate to be redeemable. If the credit of a gift voucher is not sufficient for the order, the difference can be made up with the payment options offered. Gift certificates and credits can only be redeemed before completing the order process. The balance of a gift certificate will not be paid out in cash, nor will it earn interest. From the date of purchase, the vouchers are valid for four years.
14. notice according to battery law
Since our shipments may contain batteries and rechargeable batteries, we are required by the Battery Act (BattG) to inform you of the following: Batteries and rechargeable batteries may not be disposed of in household waste, but you are legally obliged to return used batteries and rechargeable batteries. Used batteries may contain harmful substances that can damage the environment or your health if not stored or disposed of properly. However, batteries also contain important raw materials such as iron, zinc, manganese or nickel and can be recycled. You can either return the batteries to us after use or return them free of charge in the immediate vicinity (e.g. in retail outlets or municipal collection points or in our dispatch warehouse).
The delivery in sales outlets is limited to the usual quantities for end users and such waste batteries that the distributor as new batteries in its product range leads or has led.
The sign with the crossed out garbage can means that you are not allowed to dispose of batteries and accumulators in the household garbage. Under this sign you will also find the following symbols with the following meaning:

15. notice according to the law for the protection of minors
If you order beer in our store, you hereby assure that you are 18 years or older and do not give the beer to young people under 16 years.
